These Terms of Service ("Terms") constitute a legally binding agreement between you and SecondCall ("we," "us," or "our") regarding your use of the SecondCall mobile application, web dashboard at secondcall.app, and any related services. "You" means any person who accesses or uses the Service in any capacity — as a parent, coach, meet official, PA announcer, or meet director.
By downloading the app, entering an access code, or otherwise using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization (such as a meet director setting up a meet), you represent that you have the authority to bind that organization to these Terms.
SecondCall is a supplemental push notification system for track and field and cross country meets. Its purpose is to deliver race call alerts to parents and coaches when an announcer triggers a notification from the web dashboard. It also provides a coordination tool allowing field event officials to request race calls from a PA announcer.
SecondCall does not manage meet entries, display results or times, replace meet management software, or serve as an official record of any kind. It is a communication aid built on top of an existing PA system — not a replacement for it.
This is the most important section of these Terms. Please read it carefully.
SecondCall is a backup notification system. The stadium's Public Address (PA) system and official meet personnel remain the only authoritative sources of race call information at any event. SecondCall notifications are not official announcements. They are a convenience tool to help parents and coaches who may be away from a speaker.
You should always remain attentive to the PA system. Do not rely on SecondCall as your sole means of knowing when your athlete needs to report. Notification delivery is not guaranteed.
The following factors are entirely outside SecondCall's control and may cause notifications to be delayed, delivered out of order, or not delivered at all:
By using SecondCall, you acknowledge these limitations and accept full responsibility for ensuring your athlete reports to staging on time. SecondCall is not responsible for any missed event, disqualification, or consequence of any kind arising from a missed or delayed notification.
The Service is provided "as-is" and "as-available" without warranties of any kind, express or implied. We do not warrant that:

To the fullest extent permitted by applicable law, SecondCall and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of or inability to use the Service.

Because SecondCall is provided free of charge to parents and coaches, our total liability to you for any claim arising from your use of the Service is limited to zero dollars ($0.00). This limitation reflects the fact that you have paid nothing for the Service and that our ability to guarantee delivery of third-party push notifications is inherently constrained.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

Meet directors create accounts to access the web dashboard and set up meets. By creating an account, you agree to:
Disposable access codes issued to announcers and officials expire when the meet ends. You are responsible for distributing these codes only to authorized staff.
Meet directors agree to indemnify and hold harmless SecondCall and its operators from any claims, damages, liabilities, or expenses (including reasonable legal fees) arising from the content of notifications or announcements sent through their account, the actions of staff operating under access codes they generated, or any breach of these Terms.
We reserve the right to suspend or terminate accounts that violate these Terms, are used fraudulently, or are used in ways that harm other users or the Service.
You may not use SecondCall to:
We are not liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control. This includes, without limitation, acts of God, weather emergencies, stadium power failures, lightning-induced evacuations, telecommunications or cellular carrier outages, internet infrastructure failures, or any other event outside our control.
In such circumstances, our obligations under these Terms are suspended for as long as the force majeure event continues.
These Terms are governed by the laws of the State of Maryland, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Maryland, and you consent to the personal jurisdiction of those courts.
Before initiating any formal legal proceeding, we encourage you to contact us at hello@secondcall.app to attempt to resolve the matter informally.
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. For material changes, we will make reasonable efforts to notify meet directors via the email address on their account.
Continued use of the Service after updated Terms are posted constitutes your acceptance of the revised Terms. If you disagree with a change, your only recourse is to stop using the Service.
